CITY COUNCIL MEETING

MAYOR EPSTEIN:    It’s 7:00 and I would like to call the meeting to order.  I’d like to ask Willis Barlow from Yeshu-Ah Breakthrough Ministries to come up and lead us in prayer.

 

WILLIS BARLOW:     Lord God, we come right now Lord God and You said indistinguishable You’d understand.  And, we pray indistinguishable that we would be clear and we could understand, Lord God.  And, we will be able to stand together as a people, Lord God, to be indistinguishable people.  And, You also said pray for those that are in leadership, Lord God.  We pray for the men, we pray for the City Council, Lord God, those in leadership Lord God.  We continue to stand together with them Lord God and we just continue to pray as a community Lord God.  We ask for forgiveness, Lord God, for the things that we have not done in the past and we pray, Lord God, that You will forgive us of our sins.  Forgive us of the things that we haven’t done and we pray Lord God as we move forth we would do everything according to Your indistinguishable and glory in Jesus’ name we pray.  Amen.

REPORT OF OFFICERS APPROVAL OF BILLS – $2,227,939.32

 

MAYOR EPSTEIN:    Motion carries.  I have no Unfinished Business.  We will move onto New Business.  The first item is an Ordinance amending our Municipal Gas Use Tax.  If you’ll recall, we have passed an Ordinance asking Nicor to collect a tax on people who do not use Nicor as their gas purveyor.  We have spoken to Nicor and there were a few minor amendments that they wanted to the Ordinance.  If there are any questions, Mr. Power would be happy to answer them.  This is just minor language change prior to them, ah, using.......starting the collection of that tax.

 

ALDERMAN HUNTER:         This essentially closes some of the loop holes?

 

ATTORNEY POWER:            Yes.

 

MAYOR EPSTEIN:    Are there any other questions?  Okay, I’ll accept..........entertain a motion to Suspend the Rules.

ALDERMAN BARON:           I would move that we Suspend the Rules that would interfere with the passage of the Municipal Gas Use Tax Ordinance.  After...before I finish my motion, ah, does the Ordinance incorporate the agreement or are we going to do that separately?

 

ATTORNEY POWER:            It does incorporate the agreement and that was added so you do not necessarily have to do so, however, you can also......... you can also do by motion simply.......

 

ALDERMAN BARON:           That’s fine.  I’m.....if it incorporates it, that’s fine. 

 

ATTORNEY POWER:            That was one of the changes.

 

ALDERMAN BARON:           The term that I noticed had.........the term expired August 1, 2009.  It’s a one-year contract right?

 

ATTORNEY POWER:            It’s a one-year agreement.  That’s correct.  The date was changed.  I believe that was the.......one of the main changes on it.

 

MAYOR EPSTEIN:    We had originally thought we could have it by July 1, and that was not possible.

FIRST READING

ORDINANCE AMENDING CHAPTER 8, SECTIONS 8-16 AND 8-17 OF THE CITY

CODE OF THE CITY OF KANKAKEE – PROPERTY MAINTENANCE

 

MAYOR EPSTEIN:    Motion carries.  The Ordinance will be back next time for a Second Reading.  Onto item........

 

ALDERMAN HUNTER:         Your Honor, can I propose a question?  What’s the economic impact on this?  What kind of money will this generate?

 

MAYOR EPSTEIN:    The estimated revenue to the City of Kankakee–when the item was going to be a two-year license at $50.00 was in excess of $40,000.00.  I have not computed the new three-year $60.00 license indistinguishable charge.

 

ALDERMAN HUNTER:         And, that was through...........the three-year was negotiated with.....

 

MAYOR EPSTEIN:    The three-year was negotiated after meeting with a group of landlords who came to speak to me about their concerns.  And, after I explained the, ah, City’s financial position, a compromise was reached that a three-year license would be amenable to them with a $60.00 charge for the three years with the understanding that our Ordinance still provides if a rental property should look in disrepair, that Code can still go in, obviously, and do an inspection.  But, those landlords that maintain their properties would have three years without having to endure inspections.  And, that is per building.  That is not a per-unit rental license fee.  Moving onto Item D.  This is amending our Municipal Code for a Class F License for liquor.  Actually, this Ordinance would make our local liquor commission in........consistent with the State of Illinois licensing.  We now have........when we have a catering or special event, we really do not have a license that serves the purpose of a special use permit license.  The State does.  Our Ordinance does not have that and we wanted to include a Special Use Permit Liquor License for catering events or people who are doing one-time events and they do not have a liquor license.  And, we wanted to be consistent with the State.  Do I have a motion to Suspend the Rules?

ALDERMAN HUNTER:         Yeah, for the record, Mr. Simms, what prompted this?  I know what prompted it, but could you just, in a nutshell, ah, give a rationale for this in terms of the tipping fees and all the other stuff.

 

RICHARD SIMMS:    Yes.  Several years ago, the solid waste function was removed from the General Fund, subsidized out of the General Fund and made separate operating the Utility, the Sewer Utility.  At that time, the Ordinance was structured so that the user fees must cover the total cost of service rendered.  And, so every year we evaluate the cost associated with collection and disposal by the contractor as well as services rendered by Public Works Department that total the total expense.  We compare that to the revenues that are occurring and we recommend adjustments. 

 

MAYOR EPSTEIN:    Are there any other discussions or questions?

ALDERMAN WILLIAMS:     I would just like to say that, ah, in my vote, I know there’s got to be a trade off somewhere.  I voted against the landfill, but the trade off has to be with this fee indistinguishable it is.

 ORDINANCE AMENDING CHAPTER 32, SECTION 231 ESTABLISHING

A HANDICAPPED PARKING SIGN AT 1481 S. SEVENTH AVENUE

 

MAYOR EPSTEIN:    Motion carries.  In Motions and Resolutions, you’ll see a Resolution authorizing the purchase of a new 2010 Chevy Malibu.  Chief Young was very diligent and went out and we were able to secure this automobile using the Cash for Klunkers stimulus that the government has promoted.  If you have any questions for Chief Young, I’m sure he would be happy to answer them for you.  This is replacing the vehicle that we surplused a couple of minutes ago.

 

ALDERMAN BROWN:          It’s coming out of his budget?

 

MAYOR EPSTEIN:    This is coming out of Capital.  So, this is not coming out of General Revenue.  This is the Capital Purchase item for the Fire Department.

MAYOR EPSTEIN:    Motion carries.  We will need an Executive Session this evening to discuss Pending Litigation.  I also would like to just take a moment to thank the Police and Fire Department.  Sunday’s event with our returning troops was spectacular.  The City of Kankakee, the residents were amazing, our police and firemen did a wonderful job in their guidance of all the traffic and, ah, just the decorating.  I thought the flag hanging on Indiana was great and I think we should all be proud of our community and our County and, ah, most importantly, of the men and women who came home safely back to their families on Sunday.  So I wanted to thank all of you who participated and attended the event.  Ah, we will clear the Chambers now.  A motion to go into Executive Session.

ALDERMAN JONES:             Mayor, I–there’s a donation letter in the packet.  I indistinguishable  $350.00 towards the back-to-school supplies indistinguishable school and indistinguishable tonight.

 

MAYOR EPSTEIN:    Okay.  Alderman Jones has a request for–I need a motion to donate to the block party for back-to-school supplies for the students of Steuben School.

 

ALDERMAN JONES:             So moved.
